By purchase of one or more products (including, without limitation, any Plate Covers, Vanity Plates, or Plate Frames, the "Products") offered for sale on this website by Cover My Plate, LLC ("Seller"), you, as the buyer of said products ("You" or "Buyer"), acknowledge and agree that the Products offered hereon are intended solely for display and novelty purposes and are not designed or intended to replace officially registered license plates.

You hereby acknowledge and agree that the laws of every state, territory, and local jurisdiction of the United States (including, without limitation, Florida Statutes § 316.605, California Vehicle Code § 5201, Texas Transportation Code § 502.409, 625 Illinois Compiled Statutes 5/12-610.5, and comparable statutes, regulations, and ordinances in every other state and jurisdiction) prohibit or restrict the placement of any item or matter on the face of a license plate that could block, obscure, distort, or otherwise render the license plate not clearly visible or legible, whether to the human eye or to any camera, scanner, sensor, or other electronic or photographic device. These laws vary by state and are subject to change, and some states and jurisdictions prohibit the use, sale, or manufacture of license plate covers of any kind regardless of purpose. Accordingly, the Products are not intended for use on any vehicle that is operating, driving, stopped, or parked on any public highway, road, street, or public accommodation anywhere in the United States, and are not intended to cover, obscure, distort, or otherwise interfere with your license plate or any letters, numerals, printing, writing, registration decal, or alphanumeric designation thereon, except as otherwise expressly permitted by the applicable laws of your state and local jurisdiction.

Seller does not manufacture, market, sell, or intend the Products to be used for the purpose of obstructing, defeating, evading, or otherwise interfering with the operation of any traffic enforcement camera, red light camera, speed camera, toll collection system, automated license plate reader, or other electronic or photographic monitoring system operated by any governmental entity or private company, on any vehicle operating upon any public road, street, or highway in the United States. Any use of the Products for such a purpose is expressly prohibited by Seller, is undertaken solely at Buyer's own risk, and is contrary to the sole intended purpose of the Products as stated herein.

Failure to use the Products in compliance with the applicable law and regulation of your state and local jurisdiction may result in civil or criminal penalty, up to and including fines, court costs, vehicle impoundment, and in some jurisdictions, misdemeanor or other criminal charges. YOU ARE HEREBY ADVISED TO CONSULT AND COMPLY WITH ALL APPLICABLE FEDERAL, STATE, AND LOCAL LAWS AND REGULATIONS BEFORE USING THE PRODUCTS ON ANY MOTOR VEHICLE. EXCEPT AS OTHERWISE MAY BE PROVIDED HEREIN, SELLER MAKES NO WARRANTY WHATSOEVER WITH RESPECT TO THE PRODUCTS INCLUDING ANY (A) WARRANTY OF MERCHANTABILITY; (B) WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE; OR (C) WARRANTY AGAINST INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS OF A THIRD PARTY; WHETHER EXPRESS OR IMPLIED BY LAW, COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE OF TRADE, OR OTHERWISE.

Seller hereby disclaims, and Buyer hereby waives, any and all liability for any damages arising from the use or misuse of the Products, including but not limited to direct, indirect, incidental, or consequential damages. Buyer hereby fully release and discharges Seller and its agents, affiliates, members, managers, officers, servants and employees, from any and all liability, claims and causes of action, damages or losses, including, but not limited to, attorneys' fees, which Buyer may sustain arising out of or in connection with Buyer's use of the Product(s) in any manner that is not compliant with all laws and regulation applicable to the use of the Product(s) by Buyer. Seller and Buyer hereby agree that the purchase and sale of the Products and any agreement entered into by the parties with respect thereto shall be governed by, and construed in accordance with the laws of the State of Florida without giving effect to any conflict of laws provisions thereof. All legal proceedings arising out of or related to any of the Products shall be instituted solely and exclusively in the state or federal courts located in Duval County, Florida. Seller and Buyer each hereby irrevocably and unconditionally submits to the exclusive jurisdiction of such courts. Buyer hereby agrees that if any of the foregoing term or provision is determined to be invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affectany other terms or provisions set forth herein or invalidate or render unenforceable such term or provision in any other jurisdiction. SELLER AND BUYER EACH HEREBY KNOWINGLY, VOLUNTARILY AND INTENTIONALLY WAIVE ANY RIGHT TO A JURY TRIAL IN RESPECT TO ANY CLAIMS ARISING OUT OF OR IN CONNECTION THE PURCHASE AND SALE OF THE PRODUCTS AND ANY AGREEMENT ENTERED INTO BY THE PARTIES WITH RESPECT THERETO. THIS PROVISION IS A MATERIAL INDUCEMENT FOR THE PARTIES TO AGREE TO PURCHASE AND SELL THE PRODUCTS.

Buyer acknowledges and agrees that Buyer is 18 years old or older and of sound mind, and that this Product Disclaimer is binding upon Buyer and Buyer's heirs, personal representatives and anyone else entitled to act on Buyer's behalf.

ACCORDINGLY, YOU ARE HEREBY ADVISED TO CONSULT AND COMPLY WITH ALL APPLICABLE FEDERAL, STATE, AND LOCAL LAWS AND REGULATIONS IN YOUR JURISDICTION BEFORE USING THE PRODUCTS ON ANY MOTOR VEHICLE.
